TERMS AND CONDITIONS OF USE AND CONTRACTING

1. Nature of the service
Tapdevi (hereinafter, "the Platform") is an online intermediation service that connects users interested in wine tourism experiences with the establishments that provide them (wineries, cheese factories and other providers; hereinafter, "the Provider").
The Platform acts solely as an intermediary. The service, activity and experience are provided directly and exclusively by the Provider, who is solely responsible for its organisation, execution, quality, safety and compliance with applicable regulations (health, safety, consumer and any other).
2. Liability
Tapdevi does not organise, direct or supervise the experiences offered by the Providers. Consequently, the Platform assumes no liability for:
- The provision of the contracted service, its content, quality or development.
- Personal, material or any other type of damage that may occur during or as a result of the experience.
- Incidents arising from the consumption of food or drink, allergies, intolerances or other health circumstances of the user.
- The Provider's compliance with the regulations applicable to it.
The user acknowledges that any claim relating to the experience must be addressed to the Provider, the effective provider of the service.
3. Bookings and payments
The Platform manages the booking process and the collection of the corresponding amount. There are two purchase modes:
- Experience booking (with date): the amount is pre-authorised on the user's payment method and is not effectively charged until the Provider confirms the booking. If the Provider does not confirm within the established period, the hold is automatically released and no charge is made.
- Purchase as a gift (voucher): payment is firm and immediate at the time of purchase. As it is a voucher redeemable by a third party, the amount is charged definitively and is not subject to subsequent confirmation by the Provider.
The purchase of a gift voucher constitutes a firm purchase. The right of withdrawal may be excluded under the terms provided by the consumer regulations applicable to leisure services and activities on a specific date. The voucher will be valid as indicated in the document itself.
4. User obligations
The user undertakes to provide truthful information, to inform the Provider of any relevant circumstance for the experience (allergies, intolerances, health conditions, number of attendees) and to respect the Provider's conditions and instructions during the activity.
5. Cancellations and modifications
The cancellation and modification conditions of each experience depend on the Provider and will be indicated, where appropriate, in the booking details. For any query, the user may contact the Platform, which will forward the request to the Provider.
6. Intellectual property
The contents of the Platform (texts, images, trademarks, logos) are protected by intellectual and industrial property rights and may not be reproduced without authorisation.
7. Applicable law
These conditions are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts and tribunals that correspond in accordance with the applicable consumer regulations.
